Damages, delays or liabilities associated with the land is the responsibility of the purchaser and the land developer.

HOUSE AND LAND PACKAGE PRICING DISCLAIMERS

This House and Land Package Pricing Disclaimer applies to all house and land packages advertised, published or promoted by or on behalf of Enthusiast Enterprises Pty Ltd trading as Mr Enthusiast (“Mr Enthusiast”). This includes packages advertised on the Mr Enthusiast website, social media platforms, digital advertisements, printed materials and any other media.

GENERAL INFORMATION

All house and land packages are provided for general information and advertising purposes only. Package details do not constitute a formal quotation, contractual offer, financial advice or a guarantee that a particular home, lot, price, inclusion or promotion will remain available.

Mr Enthusiast is an independent building broker and client advocate. Unless expressly stated otherwise, Mr Enthusiast is not the builder, registered proprietor, land developer, selling agent, financier, conveyancer or owner of the land or home design advertised.

Mr Enthusiast may advertise land, home designs, specifications, promotions and pricing supplied by third-party builders, landowners, developers, selling agents or other authorised parties. Mr Enthusiast relies on information provided by these parties and may not independently verify every detail before publication.

While reasonable care is taken to ensure advertised information is accurate and current, errors, omissions or changes may occur. Prospective purchasers should not rely solely on an advertisement when making a purchasing, building or financial decision.

PACKAGE AVAILABILITY AND SUSTAINABILITY

Every house and land package is subject to the continued availability of both the advertised land and the nominated home design.

The availability, suitability, dimensions, orientation, zoning, servicing, design requirements and development conditions applying to a lot may change without notice.

A home design may not be suitable for every lot. Suitability is subject to matters including, but not limited to:

  • the size, shape, frontage, orientation, slope and levels of the lot;
  • soil classification and engineering requirements;
  • retaining, drainage and site-access requirements;
  • bushfire attack level, coastal, noise, environmental or heritage requirements;
  • easements, covenants and servicing locations;
  • local government requirements;
  • developer design guidelines and estate requirements;
  • planning, building and regulatory approvals; and
  • the requirements and acceptance criteria of the selected builder.

No land or home is reserved by viewing, enquiring about or expressing interest in a package. Availability must be confirmed with the relevant landowner, developer, selling agent and builder at the time of enquiry and again before entering into any contract.

ADVERTISED PRICING

All advertised prices are current as at the date of publication and are subject to change without notice.

An advertised package price is indicative only and is based on the information, home design, specifications, inclusions, land price and site-cost assumptions available at the time the package is prepared.

Unless expressly stated otherwise, an advertised price is not a fixed or final contract price.

The final price may change because of variations to:

  • the price or availability of the land;
  • the selected builder’s pricing;
  • the home design, floor plan, façade or elevation;
  • standard specifications and inclusions;
  • client-requested selections, upgrades or variations;
  • site works and engineering requirements;
  • service connections and authority requirements;
  • planning, building or developer requirements;
  • statutory charges, levies, taxes or fees;
  • promotions, rebates, grants or incentives;
  • material, labour, supplier or construction costs; and
  • any other cost that could not reasonably be confirmed when the package was advertised.

A final construction price can generally only be established after the relevant builder has reviewed the selected lot, received all required information and completed the necessary investigations. These may include a feature survey, soil test, engineering assessment, site classification, siteworks assessment, service-location review, planning review and confirmation of developer or local-government requirements.

The land price may also be subject to valuation, availability, seller approval and the terms of the applicable land sale contract.

Mr Enthusiast, the relevant builder, landowner, developer and selling agent reserve the right to amend or withdraw advertised pricing, designs, specifications, inclusions, promotions, siteworks allowances and package details at any time, subject to any applicable contractual or legal obligations.

SITEWORKS AND ALLOWANCES

Where an advertised price includes an allowance for siteworks or other costs, the allowance is an estimate only unless expressly confirmed otherwise in writing by the relevant builder.

Actual siteworks costs may differ following completion of the builder’s site investigations, surveys, engineering reports and final assessment of the selected lot.

Additional costs may arise from matters including, but not limited to:

  • soil conditions;
  • rock excavation;
  • cut and fill;
  • retaining walls;
  • stormwater management;
  • drainage;
  • deep sewer connections;
  • service connections;
  • demolition or clearing;
  • traffic-management requirements;
  • restricted site access;
  • bushfire, acoustic or coastal requirements;
  • wind classifications;
  • developer requirements; and
  • changes in levels, engineering or construction methodology.

Any difference between an advertised allowance and the actual cost will be reflected in the builder’s quotation or building contract.

LAND COMPONENT

The land included in an advertised package may be owned or controlled by an independent landowner or developer and may be marketed through a separate licensed selling agent.

Where Mr Enthusiast does not own the land, the package is advertised with information or authority provided by the relevant landowner, developer or selling agent.

At the time of publication, Mr Enthusiast understands the advertised land to be available and the land price to be current. However, Mr Enthusiast does not guarantee that the land will remain available or that its price, dimensions, titles, settlement timing, services, characteristics or conditions will remain unchanged.

Unless expressly stated otherwise, the advertised land price does not include:

  • transfer duty;
  • settlement-agent or conveyancing fees;
  • finance costs;
  • valuation fees;
  • mortgage-registration fees;
  • title-registration fees;
  • adjustments at settlement;
  • government or authority charges; or
  • any other costs or disbursements associated with purchasing or settling the land.

Prospective purchasers must make their own enquiries regarding the land and should obtain independent legal, conveyancing, financial, planning and technical advice before entering into a land contract.

HOME DESIGN AND CONSTRUCTION COMPONENT 

The advertised home design may be owned by, licensed to or supplied by an independent builder or design owner. Mr Enthusiast may have authority to advertise the design but does not claim ownership of third-party designs unless expressly stated.

The availability of a home design, façade, specification, promotion or inclusion is subject to confirmation by the relevant builder.

The builder may alter a design, plan, specification or inclusion where required to:

  • suit the selected lot;
  • comply with structural or engineering requirements;
  • comply with the National Construction Code;
  • comply with applicable legislation, regulations or Australian Standards;
  • obtain planning or building approval;
  • comply with local-government requirements;
  • comply with developer design guidelines or covenants;
  • address product availability or discontinuation; or
  • satisfy the builder’s construction requirements.

The final design, inclusions, specifications, construction price and building obligations will be set out in the quotation, preliminary agreement and building contract issued by the selected builder.

IMAGES, PLANS AND ILLUSTRATIONS

All photographs, renders, floor plans, site plans, elevations, maps, dimensions and other images are provided for illustrative purposes only.

Images may show items that are not included in the advertised price, including but not limited to:

  • furniture;
  • décor;
  • window furnishings;
  • feature lighting;
  • landscaping;
  • paving;
  • fencing;
  • pools;
  • outdoor kitchens;
  • pergolas;
  • sheds;
  • retaining walls;
  • upgraded façades;
  • upgraded finishes;
  • appliances;
  • air conditioning;
  • solar systems;
  • floor coverings;
  • security systems;
  • additional cabinetry; and
  • other fixtures, fittings, upgrades or display-home features.

Colours, finishes, materials, fixtures and products may also appear differently in photographs, renders, screens or printed materials.

Block boundaries, building positions, setbacks, dimensions and landscaping shown in illustrations may not accurately represent the selected lot or final approved design.

Prospective purchasers should speak with a Mr Enthusiast Sales Consultant and review the relevant builder’s written plans, specifications and inclusions before making a decision.

GRANTS, REBATES AND INCENTIVES

Where an advertised package price includes or assumes a government grant, rebate, builder promotion, developer incentive or other concession, this will apply only where expressly stated.

Eligibility requirements, values, commencement dates, expiry dates and availability are determined by the relevant government body, builder, developer or third party and may change without notice.

The First Home Owner Grant, including any advertised adjustment based on a $10,000 grant, is available only to eligible applicants who satisfy the applicable government requirements.

Mr Enthusiast does not guarantee that a purchaser will qualify for any grant, rebate, concession or incentive. Purchasers should confirm their eligibility independently before relying on an adjusted package price.

SEPARATE LAND AND BUILDING CONTRACTS

A house and land package is generally made up of separate land and building transactions.

The purchaser may be required to enter into:

  1. a land sale contract with the relevant landowner or developer, usually through the appointed selling agent; and
  2. a separate building contract with the selected builder.

Mr Enthusiast is not a party to those contracts unless expressly identified as a contracting party in the relevant written agreement.

The landowner, developer, selling agent and builder remain responsible for their respective contractual obligations.

The purchase of land does not automatically guarantee that the selected builder, design, construction price or commencement timeframe will remain available. Likewise, selecting a builder or home design does not guarantee that the advertised land will remain available.

Purchasers should obtain independent legal and financial advice before signing any land, building or related agreement.

BUILDER RESPONSIBILITY, WARRANTIES AND DEFECTS

The selected builder is responsible for the construction of the home and for the obligations contained in the building contract.

Subject to applicable law, matters relating to construction quality, workmanship, materials, product warranties, maintenance, defects, delays, damage and rectification are the responsibility of the selected builder, manufacturer, supplier or other relevant contracting party.

Mr Enthusiast may assist clients by communicating with the relevant parties as part of its service, but this does not transfer the builder’s, supplier’s, developer’s or landowner’s legal or contractual responsibilities to Mr Enthusiast.

Nothing in this disclaimer excludes, restricts or modifies any consumer guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified under the Australian Consumer Law or any other applicable legislation.

INDEPENDANT ENQUIRIES

Before entering into any agreement, prospective purchasers should:

  • confirm that the land remains available;
  • obtain the current land price;
  • confirm that the selected home design remains available;
  • obtain a written list of inclusions and exclusions;
  • obtain a lot-specific building quotation;
  • review the expected siteworks and provisional allowances;
  • investigate applicable planning and developer requirements;
  • confirm eligibility for any grant, rebate or incentive;
  • obtain finance approval; and
  • seek independent legal, conveyancing, financial and technical advice where appropriate.

MR ENTHUSIAST REFERRAL PROGRAM TERMS AND CONDITIONS

These Terms and Conditions apply to the Mr Enthusiast Referral Program operated by Enthusiast Enterprises Pty Ltd trading as Mr Enthusiast.

  1. Eligibility

To participate as a Referrer, you must:

  • be a previous Mr Enthusiast client;
  • have entered into a building contract arranged through Mr Enthusiast with a builder on the Mr Enthusiast builder panel (past or present);
  • have reached construction stage with all required progress payments up to date; and
  • comply with these Terms and Conditions.

Referred Buyer must:

  • be a new client of Mr Enthusiast;
  • not have previously enquired with, been introduced to or engaged Mr Enthusiast regarding their proposed build;
  • not already be actively engaged with the relevant builder on the Mr Enthusiast builder panel; and
  • enter into a building contract arranged through Mr Enthusiast with a builder on the Mr Enthusiast builder panel.
  1. Submitting a Referral

The Referrer must obtain the Referred Buyer’s permission before providing their personal details to Mr Enthusiast.

The referral must be submitted before, or at the time of, the Referred Buyer’s first interaction with a Mr Enthusiast Sales Consultant. Referrals submitted after this time may not be eligible.

Only one Referrer may be recognised for each Referred Buyer. Where more than one referral is received, Mr Enthusiast will generally recognise the first eligible referral recorded in its system.

  1. Referral Reward

The referral reward is valued at up to $2,000 and may be allocated as one of the following:

  • a $2,000 gift card for the Referrer;
  • a $2,000 prestart allowance for the Referred Buyer; or
  • a $1,000 gift card for the Referrer and a $1,000 prestart allowance for the Referred Buyer.

The selected allocation must be agreed with Mr Enthusiast and recorded before the Referred Buyer executes their building contract.

Any prestart allowance:

  • must be included in the Referred Buyer’s building contract or related contract documentation;
  • may only be used towards approved prestart selections or variations; and
  • cannot be transferred, exchanged or redeemed for cash.

Any gift card will be subject to the issuing provider’s applicable terms, conditions and expiry requirements.

  1. Payment of the Reward

The referral reward becomes payable or available only after:

  • the Referred Buyer’s building contract has become unconditional;
  • construction has commenced;
  • the home has reached slab stage; and
  • all amounts then due under the building contract have been paid.

Payment or issue of the reward may take a reasonable period after Mr Enthusiast confirms that these conditions have been satisfied.

If the building contract is cancelled, terminated, rescinded or does not proceed to slab stage, no referral reward will be payable.

  1. Verification and General Conditions

Mr Enthusiast may request information reasonably required to verify the eligibility of the Referrer, Referred Buyer or referral.

Mr Enthusiast may refuse or cancel a referral where:

  • the eligibility requirements have not been met;
  • information supplied is incomplete, inaccurate or misleading;
  • the referral was submitted after the Referred Buyer had already engaged with Mr Enthusiast or the relevant builder;
  • there is evidence of fraud, manipulation or misuse of the program; or
  • providing the reward would breach any applicable law or builder requirement.

Referral rewards cannot be combined with another referral reward for the same Referred Buyer unless Mr Enthusiast agrees otherwise in writing.

  1. Changes to the Program

Mr Enthusiast may amend, suspend or withdraw the Referral Program at any time.

Any change will not affect an eligible referral already accepted and recorded by Mr Enthusiast before the change takes effect, unless the change is required by law or the referral later becomes ineligible under these Terms and Conditions.

Mr Enthusiast will consider any referral dispute reasonably and in good faith. Nothing in these Terms and Conditions excludes or limits any rights that cannot lawfully be excluded under the Australian Consumer Law.

Participation in the Referral Program constitutes acceptance of these Terms and Conditions.
